Reaffirming a debt requires you to sign a new contract with the creditor and this new agreement survives the bankruptcy. This is often not advised by bankruptcy attorneys in the Boston area, particularly because it creates an unnecessary obligation on behalf of the client or debtor. If the debtor has a loan on a car and wants to continue making payments on the car, then he or she does not want to perhaps be stuck with a contract that will be legally binding.
If the debtor proceeds with a reaffirmation agreement without an attorney, then the Court will have to approve the new contract provided the agreement does not result in undue hardship to the debtor.
