What If I Do Not Agree with an Order That Was Entered in My Bankruptcy Case?

There are 2 options for when one does not agree with an order that was entered in their bankruptcy case. The first option is a motion to reconsider the order that may be filed with the Bankruptcy Court. The second option is to appeal the order. However, both of these options have a deadline. The deadline for taking either of these actions is 10 days from entry of the contested order. A party may file a motion requesting an extension of time to file an appeal, however that must also be filed no later than 10 days after the entry of order being appealed. There is currently a fee of $255 that must be paid when the notice of appeal is filed. When the appeal is filed, the matter is then referred to the Bankruptcy Appellate Panel or to the United States District Court.
