Can I File For Bankruptcy More Than Once?
Yes, there is no limit to the number of times you can file for bankruptcy. However, there are some restrictions.
For a Chapter 7 bankruptcy, you cannot file unless it has been more than 8 years since you received a discharge from previous Chapter 7 or Chapter 13 bankruptcy. For a Chapter 13 bankruptcy, you cannot file unless it has been at least 4 years since you received a discharge in a previous Chapter 7 bankruptcy; or 2 years since you received a discharge from a previous Chapter 13 bankruptcy.
Therefore, as long as the debtor meets the guidelines and requirements regarding income and the length of time between filing again, then he or she is able to go ahead and use bankruptcy again.
