What If I Have Been The Beneficiary of Additional Erroneous Social Security Payments?

There are many cases where erroneous overpayments were dispensed by the Social Security Administration, Welfare or Unemployment agencies. These government agencies often try to recoup the overpayments by garnishing from future payments of the recipient. This often leads to hardships, ones that the recipients did not intend.

The Bankruptcy Court in the Boston area will look at such hardships from a different standard than the governmental agencies. The Court is much more sympathetic to the debtor whereas the agencies will try to decrease future payments.

Therefore, any additional payments received over the years, could be discharged by the Bankruptcy Court and no repayment would have to be made back to those government agencies if the Court allows the discharge.
