What happens when my ex-spouse files for bankruptcy?
First of all, it is important to remember that once one files for bankruptcy, the automatic stay applies. If you are a creditor, this means that you will not be able to contact your ex-spouse in regards to receiving a payment. This would be a violation of the automatic stay.
The good news is that your ex-spouse will still be responsible for paying any child support or alimony owed to you. These debts are not dischargeable under bankruptcy. However, if you have filed a motion to increase child support payments, the court may wait to hear this matter after the bankruptcy case has concluded.
